The Givers has once again been legally recognized as holding the copyright to FIFTY FIFTY’s "Cupid", released in February 2023.
The Seoul High Court’s Civil Division 5-2 dismissed the appeal filed by FIFTY FIFTY’s label ATTRAKT in its copyright confirmation lawsuit against The Givers. The court also ordered the plaintiff to bear the appeal costs. In May last year, the court of first instance ruled that The Givers was the contracting party to the copyright assignment and that ATTRAKT could not be seen as having acquired rights to "Cupid", rejecting the plaintiff’s claims.
"Cupid", released by FIFTY FIFTY in 2023, drew global attention after entering the Billboard Hot 100. A dispute later erupted between producer The Givers and label ATTRAKT over ownership of the economic rights to the song, leading to a legal battle.
Responding to the ruling, The Givers stated, “There have been many claims not grounded in fact, but we have responded based on verifiable facts and legal principles―not speculation or emotion. This appellate decision meaningfully reaffirms our position through the judiciary’s judgment.” The company added, “We will approach other ongoing matters with sincerity and responsibility so the objective facts can be clearly sorted out in court.”
Content producer The Givers said on the 6th that it had secured a complete legal victory by winning both the first and second trials in the "Cupid" copyright case, and that it will continue to respond based on facts in other lawsuits as well.
